Fruit Smoothie

In a recent ruling, the ASA considered a consumer complaint against Ninos’ menu, which promoted a "Fruit Smoothie” in various differed fruit flavours. The complainant argued that this is not a "fruit” smoothie, as fruit flavouring was used, and not actual fruit juice or pulp.

All reasonable steps were taken by the ASA to elicit a response from the advertiser, but the advertiser failed to respond. Based on the information before it, the ASA Directorate ruled that the descriptor "Fruit Smoothie” was misleading because no evidence was submitted that actual fruit juice or pulp was used. Given this, consumers would likely be misled in their expectations.

The ASA therefore request members not to accept advertising from the Nino’s Group or any of its restaurants advertising "fruit smoothies”.
